xAI, the artificial intelligence company founded by Elon Musk, has initiated legal proceedings against former employee Xuechen Li. The lawsuit, filed on Thursday in a California federal court, accuses Li of stealing proprietary information related to the Grok AI chatbot and allegedly transferring it to OpenAI, where he was set to begin work soon. Li joined xAI in February of the previous year as part of a technical team comprised of approximately 20 engineers. His role involved training and developing the latest AI models for Grok. According to the complaint, prior to his departure, Li is said to have copied sensitive trade secrets from his company laptop to a personal storage device. In an attempt to conceal his actions, he reportedly deleted browser history and system logs, as well as renamed and compressed files before transferring them. The lawsuit claims that the stolen information encompasses advanced AI technologies that surpass those of ChatGPT and other competing platforms. These secrets, xAI argues, could significantly enhance ChatGPT by integrating Grok's innovative features, potentially giving OpenAI a formidable advantage in the highly competitive AI sector. xAI further alleges that during a meeting on August 14, Li admitted to the theft and attempted to cover it up, with additional evidence of stolen materials surfacing later. Following his resignation from xAI on July 28, Li reportedly sold approximately $7 billion in company shares and was slated to start at OpenAI on August 19. In light of these events, xAI is seeking a restraining order to prevent his employment at OpenAI, along with an unspecified amount in damages. Elon Musk's relationship with OpenAI has been tumultuous, from co-founding the organization in 2015 alongside Greg Brockman and Sam Altman to becoming one of its most prominent critics after the launch of ChatGPT in late 2022. Musk has previously sued OpenAI and its major investor, Microsoft, alleging that the company deviated from its foundational mission of benefiting society, opting instead for profit motives. OpenAI has responded with a countersuit against Musk for harassment. In a related matter, Musk also filed a lawsuit against OpenAI and Apple, accusing them of monopolizing the AI chatbot market on Apple devices.
