
On Tuesday, X Corporation, the entity formerly known as Twitter, initiated legal proceedings against a new startup named "Operation Bluebird," which is attempting to reclaim the Twitter trademark and launch a social media platform under that name. In a comprehensive 43-page lawsuit filed in federal court in Delaware, X Corporation accuses Bluebird of trademark infringement. The lawsuit emphasizes that, contrary to Bluebird's claims, Twitter has not been abandoned and remains exclusively owned by X Corp. Michael Peroff, a leader at Operation Bluebird, communicated via email that the startup anticipated legal action from X Corporation and was prepared for it. Another member of Bluebird, Stephen Coates—who previously served as Twitter’s general counsel—asserted that X Corporation has legally abandoned the Twitter mark. He stated, "Our cancellation petition is based on well-established trademark law and we believe we will be successful. They said goodbye. We say hello." As of now, X Corporation, its legal team, and CEO Elon Musk have not responded to requests for comments regarding the lawsuit. The lawsuit argues that Twitter is a globally recognized brand and asserts that it remains under the ownership of X Corp. It concludes, "Simply put, a rebrand is not an abandonment of trademark rights." Trademark attorney Josh Gerben, who has been closely monitoring the situation, noted that proving X Corporation's abandonment of the trademark would be a significant challenge, likening it to climbing "the equivalent of Mt. Everest."
