In a significant legal development, a federal judge has approved WhatsApp's plea for a permanent injunction aimed at preventing the Israeli cyberintelligence firm NSO Group from attempting to target its users. This ruling comes alongside a substantial reduction in the financial penalty that NSO Group must pay to Meta, WhatsApp's parent company. Earlier this year, a jury found NSO Group liable for over $167 million in damages due to a 2019 operation that affected more than 1,400 WhatsApp users, including journalists and human rights advocates. However, U.S. District Judge Phyllis Hamilton determined that there was insufficient evidence to classify NSO Group's actions as "particularly egregious." As a result, the punitive damages were adjusted to a ratio of 9 to 1, lowering the amount NSO Group is ordered to pay to approximately $4 million. Will Cathart, Head of WhatsApp, expressed satisfaction with the ruling, stating that it effectively prohibits NSO from targeting the messaging platform and its users in the future. He highlighted the importance of this decision, which comes after six years of legal battles aimed at holding NSO accountable for its actions against civil society members. In a related note, NSO Group has recently revealed plans to be acquired by U.S. investors.
