Apple allowed child sexual abuse materials on iCloud for years, West Viriginia Attorney General claims

The West Virginia Attorney General's office has initiated legal action against Apple, alleging that the tech giant has permitted the storage and distribution of child sexual abuse materials on its iCloud platform for years. This lawsuit contends that Apple has placed user privacy above the safety of children during this period. According to the AG's office, Apple, which maintains strict control over its technology and cloud services, cannot claim ignorance of the issue. The lawsuit highlights a stark contrast in reporting practices between major tech companies; while Google reported approximately 1.47 million incidents of such content in 2023, Apple reportedly filed only 267. "These images serve as a constant reminder of a child's trauma, with each view or share revictimizing them," stated West Virginia Attorney General JB McCuskey in a press release. He condemned Apple's alleged negligence, labeling it as "despicable." In response, an Apple spokesperson emphasized the company's commitment to user safety and privacy, particularly for children. They noted ongoing innovations aimed at combating evolving threats and ensuring a secure platform. Apple also pointed to its Communication Safety feature, designed to warn children and obscure images when nudity is detected in various messaging and sharing apps. The spokesperson further asserted that Apple’s array of parental controls is centered around user safety and privacy. The lawsuit raises concerns regarding the tools used by Big Tech to identify child exploitation material. The West Virginia AG's office mentioned that companies like Microsoft provide detection technology for free to assist in combating this issue. In 2021, Apple had announced plans to utilize its own model, known as neuralhash, for detecting child sexual abuse materials but later shelved the initiative due to privacy concerns. The lawsuit claims that neuralhash is inferior to Microsoft’s PhotoDNA technology in effectiveness. This legal action unfolds amid growing scrutiny over how Big Tech influences child safety. Earlier in 2023, New Mexico’s Attorney General accused Meta of obstructing investigations into child exploitation on its platforms, a claim that Meta has vigorously denied. The West Virginia AG's office is seeking both statutory and punitive damages, along with demands for Apple to adopt more effective detection measures.
