This lawsuit has sparked considerable debate about the nature of digital purchases and their similarity to traditional collectibles. Valve has responded publicly for the first time, likening its loot boxes to random purchases found in the physical world, such as blind-bagged toys and trading card packs. The company stated, "Generations have grown up opening baseball card packs and blind boxes and bags, and then trading and selling the items they receive." Items like baseball cards, Pokémon cards, and Labubu figures were specifically mentioned as examples of this culture. However, the comparison may not be as straightforward as it appears. Unlike physical items that can be freely traded or sold, Valve maintains strict control over its Steam Marketplace, which is the only sanctioned venue for exchanging or reselling in-game items. This limitation has led Valve to take action against third-party sites that allow the trading of these items, especially when they are used in gambling contexts. Legal experts have pointed out that Valve's management of the marketplace and its 15 percent commission on resale may contribute to establishing a tangible economic value for these randomized items. This aspect could play a significant role in determining whether these transactions qualify as gambling under the law, making the case particularly significant in the ongoing debate around digital goods.
