UK ready to impose competition interventions on Apple and Google

The UK's Competition and Markets Authority (CMA) is gearing up to introduce new regulations aimed at Apple and Google, fundamentally changing how they manage their app stores and smartphone software. This move is part of a broader initiative to impose European-style competition standards on major tech firms operating in the UK. Among the proposed changes, the CMA is looking to reduce the hefty fees—up to 30 percent—that these companies currently charge for transactions within their app ecosystems. Additionally, the CMA aims to prevent Apple and Google from prioritizing their own applications over those of competitors. The CMA announced on Wednesday that it anticipates designating both Apple and Google with “strategic market status” under the new digital markets framework. This designation will empower the authority to enforce conduct rules on these tech giants. A definitive ruling on this status is expected by October, paving the way for consultations on potential regulatory measures. According to Sarah Cardell, the CMA's chief executive, the investigation has revealed significant opportunities for enhancing innovation and consumer choice in the smartphone landscape. Proposed measures include allowing app developers to guide users toward alternative payment options outside of the app stores and fostering better interoperability between Apple's services and those offered by third parties, such as digital wallets and smartwatches. Moreover, the CMA plans to scrutinize smartphone-based artificial intelligence offerings, including Apple’s Siri and Google’s Gemini, to ensure fair competition in this rapidly evolving sector. However, a crucial decision regarding whether Apple will be mandated to permit the distribution of apps outside its App Store has been deferred until next year, drawing criticism from various developer advocacy groups. Tim Sweeney, CEO of Epic Games, known for its ongoing legal battles with Apple over payment structures, expressed disappointment in the CMA's proposed measures, labeling them as “surprisingly weak.” He highlighted the postponement of decisions on alternative app stores as a significant “missed opportunity.”
