U.K. designates Apple and Google as having ‘strategic market status,’ opening door for more regulation

The Competition and Markets Authority (CMA) of the United Kingdom announced on Wednesday that it has classified Apple and Google as having 'strategic market status' regarding their mobile platforms. This designation, which impacts the companies' operating systems, app stores, and web browsers, empowers the regulator to implement focused measures aimed at improving competition within the sector. This development follows a series of investigations initiated by the CMA in January, which included proposed interventions in July, suggesting that these tech giants might be recognized with strategic market status. To support its findings, the CMA engaged with over 150 stakeholders and held discussions with representatives from both Apple and Google. The CMA concluded that both companies possess substantial, entrenched market power and hold a strategically significant position in the mobile platform arena. Notably, the authority found that consumers in the UK are generally hesitant to switch between Apple and Google's ecosystems once they have chosen one. The study highlighted that both platforms necessitate businesses to use their app stores for app distribution in order to reach consumers. Moreover, the CMA indicated that emerging technologies, including artificial intelligence, are not expected to diminish Apple or Google’s market influence during the five-year period of this designation. Will Hayter, the executive director for digital markets at the CMA, emphasized that while Apple's and Google's platforms support thousands of businesses in marketing and selling to millions of customers, their operational rules might hinder innovation and competition. It's important to note that the strategic market status does not imply any wrongdoing by Apple or Google. Instead, this designation allows the CMA to consider measured, targeted interventions to ensure that the mobile platforms foster effective competition, providing consumers and businesses that rely on these technologies the assurance of fair treatment. In response, both companies have expressed concerns about the implications of this decision. Apple cautioned that it could delay the rollout of new features for users in the UK, a situation reminiscent of previous delays with Apple Intelligence. Google, on the other hand, questioned the reasoning behind the CMA's decision.
