Trump’s AI order may be ‘illegal,’ Democrats and consumer advocacy groups claim

President Donald Trump's recent executive order aimed at creating a national framework for artificial intelligence (AI) regulation is intended to position the U.S. ahead of China in the AI landscape and foster innovation. However, this move has drawn significant criticism from Democratic lawmakers, state officials, and consumer advocacy organizations who express concerns over the potential ramifications of the order. Senator Amy Klobuchar, representing Minnesota, voiced her apprehensions on social media, stating that the order could be illegal and detrimental to existing protections for Americans against the risks associated with AI. "This approach is misguided; we need robust federal safety standards without dismantling the limited protections currently in place," she asserted. The executive order empowers Attorney General Pam Bondi to establish a task force focused on contesting state regulations governing AI. Additionally, it instructs the Commerce Department to pinpoint state laws deemed excessively restrictive. This order is seen as a significant victory for tech giants like OpenAI and Google, along with the venture capital firm Andreessen Horowitz, who have long opposed state regulations they consider burdensome. This initiative comes on the heels of Republican efforts in Congress to impose a moratorium on state-level AI legislation, a proposal that was recently abandoned. Collin McCune, head of government affairs at Andreessen Horowitz, praised the order as a crucial step toward enhancing American competitiveness and innovation, while also urging Congress to formalize a national AI framework. Sriram Krishnan, an AI advisor at the White House, indicated that the administration aims to collaborate with Congress to legislate a robust framework. He commented on the White House's intention to counteract what they view as detrimental state laws, specifically referencing new legislation from Democratic-led states such as California and Colorado. Despite the administration's plans, Robert Weissman, co-president of Public Citizen, criticized the executive order, describing it as largely ineffective and likely to face legal challenges. He emphasized that Trump cannot unilaterally override state law and encouraged states to persist in their efforts to safeguard residents from the unregulated expansion of AI. The order's implications could be immediate for states with existing AI-related legislation, with threats of federal funding cuts for those labeled as overly restrictive. For instance, Colorado's law requiring AI developers to mitigate risks of algorithmic discrimination is set to take effect in June, and some experts believe Trump's order may not significantly alter its enforcement. In California, a new law mandates that major AI firms publicly disclose their safety protocols starting in January. State Senator Scott Wiener, who authored the law, criticized Trump's actions, suggesting they contradict his stated objective of U.S. dominance in the AI sector. He pointed out that recent approvals for chip sales to China and Saudi Arabia undermine that goal. As the debate intensifies, the future of AI regulation in the U.S. hangs in the balance, with various stakeholders poised to challenge the executive order in court and advocate for state-level protections.
