Trump administration appeals ruling blocking $100,000 H-1B fee

The Trump administration announced its intention to contest a recent federal court ruling that invalidated a significant fee increase on H-1B visa applications. This announcement came just three days after U.S. District Judge Leo Sorokin in Boston declared the $100,000 fee unconstitutional, asserting that President Donald Trump overstepped his authority by implementing what effectively constitutes a tax without Congressional approval. This ruling represents a significant setback for the Trump administration's strategy to tighten the H-1B visa program, which has been in existence since 1990 and is widely utilized by major U.S. technology firms to recruit skilled workers from abroad. The program allows American businesses to apply for permission to hire foreign employees in specialized roles for a duration of up to six years. Judge Sorokin emphasized that the nature of the $100,000 fee categorizes it as a tax, a power which Congress has not granted to the executive branch. The fee was introduced via a presidential proclamation last September, with Trump asserting that the H-1B program was being misused and displacing American workers. Previously, fees for H-1B visas ranged between $2,000 and $5,000 per application. Following Trump's proclamation, several companies, including Walmart, announced they would suspend their participation in the H-1B program. The Department of Justice has yet to respond to inquiries regarding this matter.
