
The Trump administration has initiated a lawsuit against the state of Minnesota, challenging its recently enacted law that prohibits prediction markets. This law, signed by Governor Tim Walz, represents a significant departure from the approach taken by other states, which typically impose restrictions rather than outright bans. The U.S. Commodity Futures Trading Commission (CFTC) has voiced strong opposition to Minnesota's legislation, stating that it marks an unprecedented effort by a state to hinder CFTC-regulated markets and disrupt the federal regulatory framework established over five decades ago. CFTC Chairman Michael Selig expressed concern, noting that the new law could criminalize lawful operators and participants in prediction markets, effectively turning them into felons overnight. Highlighting the implications for Minnesota's agricultural sector, Selig emphasized that farmers have depended on hedging products related to weather and crop events for many years to manage their risks. He criticized Governor Walz for prioritizing special interests over the needs of American farmers and innovators. Under the new law, creating, operating, or advertising a prediction market is classified as a felony, with enforcement scheduled to commence on August 1. The CFTC is seeking both preliminary and permanent injunctions to prevent the law from being put into effect. In defining prediction markets, the law describes them as systems enabling consumers to wager on future events that are not influenced by the contract parties' performance. These events encompass a wide range of topics, including sports, elections, and even pop culture happenings. Minnesota Attorney General Keith Ellison has pledged to defend the law in court, expressing his concerns about the potential negative effects of prediction markets on residents. He articulated that such markets could be addictive, particularly affecting young and low-income individuals, while disproportionately benefiting the wealthy. Ellison's office is currently reviewing the lawsuit and preparing a response for the upcoming legal proceedings.
