Tesla sued for allegedly preferring H-1B workers over Americans in hiring decisions

A federal lawsuit has been initiated against Tesla in San Francisco, claiming that the electric vehicle giant, led by CEO Elon Musk, has been systematically favoring H-1B visa holders over American citizens in its hiring and termination processes. The class-action complaint was filed on a recent Friday, asserting that the company has breached federal civil rights laws by prioritizing visa-dependent workers in a bid to reduce labor costs. According to the lawsuit, Tesla's hiring practices have adversely affected U.S. citizens, particularly in high-skilled positions that are frequently filled by H-1B visa holders. It is alleged that this approach allows Tesla to offer lower wages to visa workers compared to their American counterparts performing identical tasks. The case is spearheaded by two individuals, software engineer Scott Taub and human resources professional Sofia Brander, who both claim they faced discrimination in the hiring process because they did not require visa sponsorship. Taub contends that he was informed that a specific job was restricted to H-1B applicants only and was excluded from consideration for another role. Similarly, Brander, who previously worked for Tesla as a contractor, reported being denied interviews for two positions despite her relevant experience. The lawsuit highlights the fact that while visa workers constitute a small segment of the U.S. labor market, Tesla appears to favor these candidates over American citizens to exploit wage disparities, a practice referred to in the industry as wage theft. The complaint sheds light on Tesla's significant reliance on visa holders, particularly in technical roles. Reports indicate that in 2024, Tesla hired approximately 1,355 H-1B workers, coinciding with the layoff of over 6,000 U.S. employees, the majority of whom were citizens. Additionally, a social media post from Musk, dated December 27, 2024, acknowledged the importance of the H-1B visa system, describing it as 'critical' for himself and key contributors at both Tesla and SpaceX. The lawsuit seeks restitution for U.S. citizens who applied for positions at Tesla but were not selected, as well as for those who were employed and subsequently terminated. If the case is certified as a class action, it could potentially impact a significant number of current and former applicants.
