
In a landmark decision on Friday, the Supreme Court determined that former President Donald Trump lacked the authority to impose emergency tariffs aimed at curtailing illegal drug trafficking and addressing trade deficits. The ruling raises significant questions for businesses that paid the fluctuating tariffs Trump implemented during contentious negotiations with major trade partners. The Court's decision, which passed with a 6-3 vote, remands several cases back to lower courts and clarifies that the International Emergency Economic Powers Act (IEEPA) does not grant Trump the power to levy tariffs unilaterally. Chief Justice John Roberts authored the majority opinion, supported by Justices Neil Gorsuch, Amy Coney Barrett, Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson. The justices concluded that the President cannot rely solely on IEEPA for imposing tariffs of indefinite duration or unlimited amounts on any product from any nation during peacetime. Roberts emphasized that only Congress possesses the exclusive power over fiscal matters, with limited exceptions that must adhere to explicit guidelines. He criticized the government’s interpretation of IEEPA, asserting that it would result in an unprecedented expansion of presidential power in tariff policy. Notably, he pointed out that in the 50-year history of IEEPA, no President had ever invoked it to impose tariffs, especially not on such a grand scale. Following the ruling, analysts had previously estimated that the government may need to issue refunds totaling over $1 billion. However, new projections from economists suggest that the potential refunds could exceed $175 billion. This evolving situation is developing and will continue to be monitored closely.
