Supreme Court takes case that could strip FCC of authority to issue fines

The Supreme Court is poised to examine a pivotal case that may challenge the Federal Communications Commission's (FCC) authority to impose fines on telecommunications companies. This legal battle stems from sanctions levied against major carriers such as AT&T, Verizon, and T-Mobile for selling customer location data without proper consent. The controversy began when the FCC issued fines totaling $196 million against the three companies in 2024 after revelations surfaced regarding their unauthorized sharing of user location information. The FCC stated that these carriers had failed to take adequate steps to safeguard this sensitive data. AT&T successfully argued in the 5th Circuit Court of Appeals to overturn its fine, while Verizon faced defeat in the 2nd Circuit, and T-Mobile lost its case in the District of Columbia Circuit. In response, Verizon has appealed to the Supreme Court to overturn its ruling, while both the FCC and the Justice Department have requested that the Court reverse AT&T's favorable decision. The Supreme Court has accepted both petitions and will hear the consolidated cases. The oral arguments are set to take place soon, with significant implications for the regulatory authority of the FCC. The carriers contend that the fines infringe upon their Seventh Amendment rights, which guarantee the right to a jury trial. Their legal challenges reference a June 2024 ruling in the case of Securities and Exchange Commission v. Jarkesy, which found a similar system used by the SEC for imposing fines to be unconstitutional. The 5th Circuit sided with AT&T, asserting that the FCC acted improperly by serving as prosecutor, jury, and judge in these matters. Conversely, the 2nd Circuit and the D.C. Circuit ruled that the carriers could have pursued a jury trial had they chosen not to settle their fines.
