Victory for Elon Musk: US labor board abandons authority over SpaceX

In a significant shift, the National Labor Relations Board (NLRB) has decided to withdraw a complaint against SpaceX, determining that it lacks jurisdiction over the aerospace company led by Elon Musk. This ruling indicates that SpaceX will fall under the purview of the Railway Labor Act, which governs labor relations in the railroad and airline industries. The Railway Labor Act, enforced by the National Mediation Board, operates under a different set of regulations compared to those of the NLRB. One key aspect of the Railway Labor Act is its rigorous dispute-resolution process, which complicates the ability of employees in these sectors to strike. Notably, companies governed by this act are exempt from the provisions of the National Labor Relations Act. The initial complaint, filed by an NLRB regional director in January 2024, accused SpaceX of unlawfully terminating eight employees who had publicly criticized Musk, labeling him as a “frequent source of embarrassment.” The complaint sought their reinstatement, as well as back pay and formal apologies. In response to the allegations, SpaceX initiated legal action against the NLRB, arguing that the agency's structure was unconstitutional. However, the crux of SpaceX's argument—that it operates as a common carrier, akin to a railroad or airline—ultimately led to the NLRB's decision to drop the case. The U.S. regulators have now classified SpaceX as a “common carrier by air” and as “a carrier by air transporting mail” on behalf of the government. NLRB Regional Director Danielle Pierce communicated this decision in a letter dated February 6, informing the attorneys representing the dismissed employees that the agency would defer to the National Mediation Board's determination regarding SpaceX’s status as a common carrier.
