Sens. Warren and Blumenthal investigate NLRB decision to drop charges against SpaceX for retaliatory firings

Senators Elizabeth Warren and Richard Blumenthal have launched a formal inquiry into the National Labor Relations Board (NLRB) following its controversial decision to dismiss charges against SpaceX regarding alleged retaliatory firings. This investigation, revealed in correspondence obtained by CNBC, raises questions about the motivations behind the NLRB's ruling. The backdrop to this investigation involves SpaceX's ambitions to go public in June, with expectations of achieving a staggering valuation of $2 trillion. Previously, under the Biden administration, the NLRB had accused the aerospace giant of unlawfully terminating employees who criticized CEO Elon Musk in an open letter that highlighted allegations of sexist behavior and a broader culture of sexual harassment within the company. In February, the NLRB dropped these charges, citing jurisdictional challenges. Warren and Blumenthal are now seeking clarity from the NLRB, questioning whether political factors influenced the decision to abandon the case, particularly given Musk's substantial financial contributions to political campaigns, including those supporting former President Trump. The NLRB's dismissal of the charges effectively redirected the employees' complaints to the National Mediation Board (NMB), which oversees labor relations in the railroad and airline sectors. In their letter dated April 15, the senators argued that this shift undermined workers' rights, stating that the NMB's jurisdiction does not extend the same protections to labor activities as the NLRB. The senators also criticized the NMB's rationale for claiming jurisdiction over SpaceX, describing it as “absurd” to categorize SpaceX as a mail carrier based solely on its occasional delivery of packages to the International Space Station for NASA. Warren and Blumenthal have set a deadline of April 29 for the NLRB to provide detailed records explaining its jurisdictional shift and any communications with Musk or his representatives. They also seek clarification on the precedent for considering a rocket company like SpaceX as a mail carrier. In 2024, SpaceX initiated a federal lawsuit against the NLRB, arguing that its structure is unconstitutional and that the agency should not enforce actions related to worker complaints of unfair treatment. This lawsuit followed incidents where nine employees claimed they were terminated for voicing concerns in their open letter. Musk has a long-standing history of opposition to union activities, demonstrated by previous rulings against him by the NLRB in connection with labor law violations at Tesla, his automotive company. As this investigation unfolds, both the NLRB and SpaceX have been approached for comments, but responses have yet to be received.
