This provision was part of the Trump administration’s expansive budget proposal, often referred to as the 'Big Beautiful Bill.' Introduced by Senator Ted Cruz (R-TX), the measure initially garnered support from several influential figures in Silicon Valley, including Sam Altman of OpenAI, Palmer Luckey of Anduril, and Marc Andreessen from a16z. They argued that the moratorium would help avert a fragmented regulatory landscape that could hinder innovation in AI. However, the tide turned as opposition to the ban gained traction across party lines. Many Democratic senators, along with a significant number of Republicans, raised alarms about the potential risks to consumers if powerful AI companies were allowed to operate without adequate oversight. Critics expressed concerns that Cruz’s plan would link compliance with federal broadband funding to the regulation ban, complicating matters further. After extensive debate, Senator Marsha Blackburn (R-TN) proposed an amendment alongside Senator Maria Cantwell (D-WA) to remove the provision altogether. Initially, Blackburn had supported the moratorium but shifted her stance, reaching a compromise with Cruz to reduce the ban from ten years to five before ultimately withdrawing her support.
