Moratorium on state AI regulation clears Senate hurdle

A significant Republican initiative aimed at halting states from implementing their own AI regulations has successfully navigated an important procedural step in the Senate. This proposal, revised by Senate Commerce Chair Ted Cruz to align with budgetary protocols, would impose a restriction on federal broadband funding for any state attempting to enforce AI regulations over the next decade. The Senate Parliamentarian has ruled that this provision is exempt from the Byrd rule, allowing it to be incorporated into the Republicans' comprehensive legislative package known as the "One Big, Beautiful Bill." This development enables the bill to pass with a simple majority, thereby avoiding the risk of a filibuster and minimizing the need for bipartisan support from Senate Democrats. However, the level of support among Republican senators remains uncertain. For instance, Senator Marsha Blackburn from Tennessee has voiced her opposition, arguing, "We do not need a moratorium that would prohibit our states from stepping up and protecting citizens in their state." The House of Representatives had previously approved a version of this legislation featuring a similar moratorium. Yet, far-right Representative Marjorie Taylor Greene has openly opposed the measure, labeling it a "violation of state rights" and calling for its removal in the Senate. House Speaker Mike Johnson, on the other hand, has defended the moratorium, citing support from former President Donald Trump. He emphasized the need for a cohesive national approach, stating, "We have to be careful not to have 50 different states regulating AI, because it has national security implications, right?" An advocacy group named Americans for Responsible Innovation has expressed concerns regarding the proposal, suggesting that its broad language could dismantle numerous state-level initiatives designed to regulate AI and related technologies. This could lead to a regulatory void in various technology policy areas without providing federal alternatives to replace the existing state-level measures. Various states are indeed making strides towards regulating AI. In California, Governor Gavin Newsom vetoed a notable AI safety bill last year but approved several less controversial laws addressing privacy and deepfake technologies. Meanwhile, an AI safety bill has passed in New York and is now awaiting the signature of Governor Kathy Hochul, and Utah has enacted its own regulations focused on AI transparency.
