Scale AI is suing a former employee and rival Mercor, alleging they tried to steal its biggest customers

Scale AI, a company that provides data preparation services for AI model training, has initiated a lawsuit against a former employee and rival firm Mercor. The lawsuit, filed on Wednesday, accuses the ex-employee, who now works for Mercor, of unlawfully taking over 100 confidential documents related to Scale's customer strategies and other sensitive information. The legal action claims that the employee, Eugene Ling, attempted to secure a deal with one of Scale's major clients, referred to in the lawsuit as "Customer A," before officially resigning. Scale AI is pursuing charges against Mercor for the misappropriation of trade secrets and against Ling for breach of contract. Surya Midha, co-founder of Mercor, has publicly denied any wrongdoing, stating that while they have employed several former Scale employees, they have no interest in Scale's confidential information. Midha acknowledged that Ling may have retained some documents but emphasized that Mercor has not accessed them. He further mentioned that Mercor had reached out to Scale about resolving the situation and offered to have Ling delete the files. The lawsuit indicates that the stolen documents contain critical information that could enable Mercor to compete for Scale's key clients, including Customer A. Scale is demanding a complete list of files from Ling's personal Google Drive and is seeking to prevent him from engaging with Customer A. However, the lawsuit claims that Mercor has not complied with these requests. The identity of Customer A remains undisclosed in the legal documents, but the lawsuit hints that securing this client could be worth millions for Mercor. This legal dispute underscores Scale's significant concerns regarding Mercor's competitive positioning in the AI industry. Despite a substantial investment of $14.3 billion from Meta for a 49% stake in Scale, reports indicate that Meta's own AI division, TBD Labs, continues to utilize services from Mercor and other competitors in large language model training. Mercor is gaining traction in this field, particularly due to its strategy of hiring specialized content experts to enhance their data training services. In the wake of Meta's investment in Scale, several of Scale's largest customers, who are also competitors of Meta, have reportedly severed ties with the company, adding further complexity to the ongoing situation.
