Google, Epic reveal $800 million deal during antitrust trial over Play Store

This revelation comes as the two companies have been embroiled in a long-standing dispute regarding Google’s policies surrounding its Play Store. The partnership was disclosed during Epic's ongoing legal proceedings against Google in California, where court documents indicated a six-year strategic collaboration focused on Android, Fortnite, and Epic’s Unreal Engine. This legal confrontation dates back to 2020, when Epic Games circumvented Google’s in-app payment system to evade a hefty 30% commission, which led to Fortnite's removal from the Play Store and ignited a global debate over app store regulations. According to reports from The Verge, the partnership details emerged during a recent court hearing. U.S. District Judge James Donato raised concerns about whether the agreement might represent a preferential arrangement that could disadvantage other developers. The court filings outline the partnership's scope, which includes joint product development, marketing initiatives, and collaborative efforts tied to the mentioned platforms. When Epic’s CEO, Tim Sweeney, was queried about the implications of the partnership on their technology, he hesitated, acknowledging that Epic's technology is utilized by various companies in sectors where Google operates. He noted, “Epic's technology is used by many companies in the space Google is operating in to train their products, so the ability for Google to use the Unreal Engine more fullsome… sorry, I'm blowing this confidentiality.” Sweeney defended the financial arrangement, asserting that there was nothing unethical about Epic financially incentivizing Google to foster a more competitive landscape. He characterized the $800 million transfer as a substantial investment from Epic to Google. The agreement stipulates that Epic will pay this amount over six years, which has raised eyebrows considering Epic's vocal criticism of Google’s Play Store practices. Despite the financial collaboration, Sweeney clarified that the two companies are not co-developing a singular product but are separately advancing their respective product lines while planning to collaborate. Judge Donato expressed concern that Epic might have compromised its demands to finalize this agreement but ultimately decided to keep the terms confidential for the time being. This broader settlement has the potential to significantly impact how the Android ecosystem functions globally. If the court approves it, Google’s Play Store fees could be reduced to between 9% and 20% for several years, and Google would be compelled to permit third-party app stores, including the Epic Games Store, to operate within Android without resistance. The final approval of this settlement is still pending in court.
