In a significant legal challenge, Reddit is asserting its distinctiveness from traditional social media platforms as it contests Australia’s new law prohibiting children under the age of 16 from participating in social media. The lawsuit, submitted to Australia's highest court, argues that the legislation, which took effect on December 10, restricts free political discourse by preventing young individuals from sharing their viewpoints online. Reddit contends that the law should be invalidated, or at the very least, the platform should be exempted from its stipulations, as it does not fit the official definition of a 'social media platform.' The Australian High Court is being urged to consider the implications of this law, which mandates that 10 major platforms deactivate accounts for users under 16 and prevent their access to these services. Critics have raised concerns about the potential infringement on children's rights, sparking a debate over what constitutes 'social media.' In its court filing, Reddit characterized itself as a 'collection of public fora arranged by subject,' emphasizing that its primary function is not to facilitate social interactions. Instead, Reddit focuses on the exchange of information and knowledge sharing among users. The platform argues that it differs significantly from sites that encourage personal relationships, such as those that allow users to become 'friends' or share personal photos. In a statement accompanying the legal documents, Reddit admin LastBluejay highlighted the privacy and political expression concerns posed by the law. They noted, 'While we recognize the necessity of safeguarding those under 16, this legislation inadvertently imposes intrusive and potentially insecure verification processes on both minors and adults, isolating teenagers from engaging in age-appropriate community discussions, including political topics.' Additionally, Reddit pointed out that a substantial amount of content on social media platforms is available without requiring an account. It argued that enabling under-16 users to have accounts—albeit with restrictions—would provide a more effective means of protection for this demographic.
