FCC plans ID mandate that could block anonymous use of prepaid burner phones

The Federal Communications Commission (FCC) is facing backlash from privacy advocates and groups supporting domestic violence survivors due to a proposal aimed at collecting more personal information from phone users. This initiative, which is intended to combat robocalls, poses a significant challenge for individuals seeking to maintain their privacy through the use of prepaid phones, commonly known as burner phones. Under the proposed guidelines, the FCC would require phone companies to gather and keep detailed identifying information from new and renewing customers. This would include their name, physical address, government-issued ID number, and an alternative phone number before allowing them access to services. Critics argue that such a mandate would effectively eliminate the anonymity that many depend on for safety and privacy. Belle Torek, a Technology Safety Specialist at the National Network to End Domestic Violence, expressed her concerns to the FCC, stating that the privacy measures viewed as suspicious by the commission are often critical safety practices for survivors of abuse. Furthermore, the Kansas Coalition Against Sexual & Domestic Violence has warned that implementing these rules could further endanger victims of sexual assault and domestic violence. They highlighted that many survivors lack reliable access to identification and are unable to disclose their whereabouts when escaping dangerous situations. In defense of the proposal, the FCC contends that enhancing Know-Your-Customer (KYC) requirements will help deter scammers from obtaining phone services and make it easier to trace those who manage to infiltrate the network. FCC Chairman Brendan Carr noted that certain phone companies are not sufficiently vetting their customers, allowing malicious actors to exploit the U.S. phone networks. He emphasized that the proposed rules aim to close existing gaps in KYC obligations and protect Americans from fraud.
