OpenAI asserts that the aim is to determine whether Musk played a role in orchestrating the criticisms or financially supported the nonprofits in their endeavors. However, the targeted nonprofits argue that OpenAI's actions are nothing more than a strategy to intimidate and suppress dissenting voices. Emma Ruby-Sachs, the executive director of Ekō—a nonprofit committed to holding major corporations accountable—expressed her skepticism about the rationale behind the subpoenas. She stated that the premise for these legal actions is so absurd that it appears to be a mere tactic to intimidate organizations like hers into silence. Earlier this year, Ekō publicly demanded Musk's removal from his position as head of DOGE, even going so far as to display a billboard in Times Square featuring Musk with a crown, urging the public to contact Congress to express their discontent. Ruby-Sachs highlighted that Ekō is primarily funded by small donations from individuals, contradicting the narrative that they are beholden to larger interests. "We’ve run numerous campaigns against Musk in the past year," she confirmed, emphasizing the organization’s independence and commitment to its mission.
