OpenAI denies that it’s weighing a ‘last-ditch’ California exit amid regulatory pressure over its restructuring

Discussions within OpenAI's leadership about a possible move out of California have emerged, driven by increasing political resistance that jeopardizes the company's transition from nonprofit to for-profit status. Despite these speculations, OpenAI insists that there are no current plans for relocation. The California attorney general is investigating whether OpenAI's restructuring could be in violation of state charitable trust laws. This scrutiny comes alongside opposition from a coalition of nonprofits, labor organizations, philanthropies, and even competitors like Meta, all of whom are challenging the proposed conversion. OpenAI's restructuring is crucial, as it is linked to approximately $19 billion in funding. Failure to execute this transition could lead to investors withdrawing their support, posing a significant threat to the future of the company, which is renowned for its ChatGPT technology. Relocating OpenAI would be particularly surprising, given the strong connections CEO Sam Altman has with the Bay Area. He played a role in San Francisco Mayor Daniel Lurie’s transition team after Lurie’s election last year and owns multiple properties in the region, including four homes in San Francisco and another in Napa Valley. Additionally, such a move would present substantial logistical hurdles, especially since a significant portion of OpenAI's AI researchers are based in San Francisco. While OpenAI continues to collaborate with state and Delaware attorneys general regarding its restructuring, the mounting regulatory pressure complicates its existing challenges, including the fierce competition for AI talent.
