The crux of the legal debate lies in whether the virtual items obtained from these boxes qualify as “something of value” under the law. Jonathan Loiterman, a counselor at Foundation Law Group, noted that traditional gambling implies a risk of loss, whereas in this scenario, buyers always receive a product. This distinction could lead the court to view loot boxes as more similar to collectible figurines or trading card packs rather than games of chance like blackjack or roulette. Richard Hoeg, an attorney with the Hoeg Law Firm, echoed this sentiment, emphasizing that randomized sales of physical products are generally not classified as gambling since the value of the item received does not fluctuate.
