The rising issue of digital addiction, particularly among young people, has prompted New York to take decisive action. On December 26, Governor Kathy Hochul signed a new law that mandates social media platforms featuring infinite scrolling, auto-play, and algorithmic feeds to display mental health warning labels. This initiative comes on the heels of a similar move by Australia, which has restricted social media access for children under 16. Under this new legislation, the Attorney General of New York is empowered to pursue legal action against platforms that fail to comply. Companies found in violation could face substantial civil fines of up to $5,000 for each infraction, as outlined in the government’s announcement. Governor Hochul emphasized the importance of this measure, stating, “Keeping New Yorkers safe has been my top priority since taking office, and that includes protecting our kids from the potential harms of social media features that encourage excessive use.” She drew parallels between the warning labels for social media and those on tobacco products, which highlight serious health risks, such as cancer. Hochul further noted the urgent need to prioritize mental health, insisting that it is vital for the public to be aware of the risks associated with excessive social media use. The new law aims to protect not just adults but particularly vulnerable children, who face a significantly heightened risk to their mental health. As New York joins various countries in addressing the global concern of social media addiction, it is evident that a coordinated effort is necessary to tackle this pervasive issue. Currently, major platforms like Meta, Alphabet, and Snapchat have yet to respond publicly to the implementation of these new warning labels in New York.
