New York becomes first U.S. state to impose AI data center ban

In a historic move, New York State Governor Kathy Hochul has signed an executive order imposing a one-year moratorium on the construction of new large-scale data centers consuming 50 megawatts or more of power. With this decision, New York becomes the first state in the U.S. to implement such a ban. During the announcement in New York City, Hochul expressed concern over the overwhelming power demands of these hyperscale AI facilities, stating, "These hyperscale AI data centers consume enormous amounts of power, truly threatening to outpace our grid's capacity." The governor emphasized the importance of protecting New Yorkers from rising costs, as average residential electricity prices have surged nearly 68% since 2019, leading to widespread public opposition against new data center projects. Environmental advocates welcomed the moratorium. Laura Shindell, director of Food & Water Watch, remarked, "This one-year moratorium is a huge step forward for New York communities fighting against an onslaught of massive data center proposals." She attributed the governor's decision to significant public pressure from citizens demanding action to safeguard their air and water quality. Support for the moratorium extended beyond environmental circles. Senator Kirsten Gillibrand stated, "This one-year moratorium is fundamentally about trust," highlighting the need for assurances that local energy costs and resources would not be adversely affected. However, the ban has sparked criticism among some lawmakers who argue that it could hinder New York's competitive edge in the technology sector. Republican Assemblyman Scott Gray voiced concerns that the moratorium freezes investment and undermines local decision-making. Despite the pushback, a Siena Research Institute poll revealed that 46% of respondents support the moratorium, with only 21% opposing it. This sentiment appears to cross party lines, as significant support was seen among both Democrats and Republicans. Governor Hochul's action marks a significant step in regulating the impact of data centers on local communities and the environment. She has also indicated plans to pursue further legislation, including the repeal of sales tax exemptions for large data centers and ensuring that such facilities contribute to clean energy generation.
