This innovative step comes with a set of comprehensive guidelines aimed at ensuring the ethical and transparent use of this emerging technology. In a recent blog post, Netflix emphasized the importance of responsible practices, stating, "Generative AI tools (GenAI) enable rapid creation of unique media—video, audio, text, and images—now being embraced in creative workflows for content production." The streaming giant views these AI tools as beneficial creative partners but stresses the need for caution given the complex legal landscape surrounding their use. Netflix outlined several key principles that must be adhered to: outputs generated must not mirror or infringe upon copyrighted materials, the tools should not retain or repurpose production data, and where feasible, generative AI should operate within a secure environment to protect inputs. Furthermore, any AI-generated content must be temporary and cannot replace or create performances by unionized talent without explicit permission. Only those creators who can affirm compliance with all stated conditions are permitted to utilize generative AI, and those uncertain about the guidelines are encouraged to seek legal advice from Netflix prior to proceeding. The platform also specified scenarios requiring written consent before employing generative AI, such as leveraging proprietary data, training AI models on other artists' work, or creating main characters and key visuals. There are strict prohibitions on using generative AI for content related to actual events, as Netflix believes in maintaining the trust of its audience. "GenAI can blur the lines between reality and fiction if not handled thoughtfully, potentially misleading viewers.
