NAACP sues Elon Musk's xAI over Memphis data center air pollution

In a significant move, the NAACP has initiated a lawsuit against xAI, the artificial intelligence venture led by Elon Musk, alleging violations of the Clean Air Act. The legal action, filed on Tuesday in the U.S. District Court for the Northern District of Mississippi, centers around the company’s use of natural gas turbines to power its data centers in the Memphis area. The lawsuit claims that between August and December 2025, xAI and its subsidiary, MZX Tech, LLC, installed and operated 27 gas turbines in Southaven, Mississippi, without obtaining the necessary air permits. This operation is said to pose health risks to local residents due to the emission of pollutants and particulate matter, which contribute to smog and unpleasant odors. The NAACP is seeking both declaratory and injunctive relief, demanding that xAI halt operations at the Colossus Gas Plant until proper permits are secured and adequate pollution controls are implemented. The organization is also pursuing civil penalties for each day of alleged violations. Abre' Conner, the NAACP’s Director of Environmental and Climate Justice, emphasized the importance of clean air, stating, "Our right to clean air is not up for negotiation, especially when companies prove expediency not people is their priority." xAI, which became part of SpaceX following a recent merger, has claimed that the use of natural gas turbines was temporary and did not require federal permits. The company oversees the Colossus 1 and Colossus 2 data centers in Memphis and is in the process of constructing another facility called Macrohardrr in Southaven, which will include a more permanent power plant equipped with 41 natural gas turbines. The lawsuit highlights that tens of thousands of individuals live, work, and study in proximity to xAI's operations, with a significant portion of this population being Black, which raises additional concerns regarding environmental justice. In a related action, the NAACP is urging Mississippi state regulators to revoke a permit granted to xAI in March, which authorized the expansion of its power plant. Musk's company is relying on the Memphis area as a key component of its strategy to compete with established players in the AI sector. The situation is further complicated by ongoing scrutiny from regulatory bodies in the EU and the UK, following controversies surrounding xAI's products that have enabled the creation of deepfake content without consent. Amid these challenges, SpaceX's acquisition of xAI, valued at $1.25 trillion, positions the company for a potential record IPO in the near future. Legal representation for the NAACP includes the environmental advocacy groups Earthjustice and the Southern Environmental Law Center.
