Elon Musk's artificial intelligence venture, xAI, is intensifying its legal battle with OpenAI. The company has filed a lawsuit in the US District Court for the Northern District of California, claiming that OpenAI has unlawfully recruited its employees and misappropriated proprietary technology. The lawsuit, lodged on Wednesday, accuses OpenAI of a troubling pattern of behavior aimed at acquiring trade secrets linked to Grok, xAI's leading chatbot. According to Musk's legal team, the complaint states, "OpenAI is not merely soliciting or hiring a competitor's employees; it is conducting a coordinated, unfair campaign targeting individuals who possess critical knowledge about xAI's technologies and business strategies." Moreover, the lawsuit alleges that OpenAI has encouraged these former employees to breach confidentiality agreements with xAI. In response, an OpenAI spokesperson refuted the claims, stating, "This new lawsuit marks another instance of Mr. Musk's ongoing harassment. We have zero tolerance for any violations of confidentiality and have no interest in the trade secrets of other organizations." The suit specifically mentions ex-xAI engineer Xuechen Li, who is already embroiled in a separate legal matter initiated by xAI over purported trade secret theft. Recently, on September 3, xAI secured a temporary court order preventing Li from engaging with or discussing AI technology with OpenAI. A source familiar with the situation revealed that Li has never been employed by OpenAI. Additionally, xAI alleges that OpenAI has successfully recruited "early xAI engineer" Jimmy Fraiture, along with a senior finance executive, in an effort to gain access to sensitive information. Fraiture is not named as a defendant in the lawsuit. Requests for comments from Li went unanswered. This legal action adds to the ongoing conflicts between Musk and OpenAI, a company he helped establish in 2015. Separately, xAI has also filed suit against Apple, claiming the tech giant has collaborated with OpenAI to suppress competition. Musk is pursuing claims that OpenAI has strayed from its original nonprofit mission by transforming into a for-profit entity. OpenAI has countersued Musk for harassment, further complicating the legal landscape. Legal representatives for xAI have not provided comments regarding recent developments, and Musk has also not responded to inquiries.
