All of DOGE’s work could be undone as lawsuit against Musk proceeds

Elon Musk is now required to defend his actions in a lawsuit claiming he unlawfully consolidated too much authority while leading the Department of Government Efficiency (DOGE). A ruling from a judge on Monday stated that Musk may have bypassed necessary Senate confirmation for significant decisions such as agency eliminations, widespread layoffs, and severe budget reductions. The lawsuit contends that Musk's actions exceeded the powers outlined in President Donald Trump's extensive DOGE executive orders. It accuses him of stretching his authority further than any presidential advisor in history. US District Judge Tanya S. Chutkan, in her decision partially rejecting a motion to dismiss, dismissed the government's argument that Musk did not occupy a legally recognized office, which would exempt him from Senate confirmation requirements. Judge Chutkan expressed concern over the government's position, highlighting that senior officials like the White House Chief of Staff or Counsel, while not formally recognized as officers, still exert significant influence within the government. She labeled the government's defense as 'disquieting,' stating, 'Defendants appear to make the extraordinary argument that an individual who holds an important office and wields immense power is not subject to the Appointments Clause so long as the office was unlawfully created.' Chutkan emphasized the importance of maintaining checks and balances, arguing that if a president could unilaterally create an office and appoint someone to it without Senate confirmation, it would undermine Congress's role. She noted that the powers attributed to the head of DOGE are substantial and cannot be equated with those of cabinet members under Trump, reinforcing the gravity of the allegations against Musk.
