Motorola sues social platforms and creators over posts, raising speech concerns in India

In a significant legal move, Motorola has initiated a lawsuit in India against social media platforms and content creators, claiming defamation. This lawsuit has sparked alarm among experts who fear it could stifle critical discourse about the company. Filed in a Bengaluru court, the suit targets major platforms such as X, YouTube, and Instagram, along with numerous content creators. Motorola is demanding the removal of posts it deems false or defamatory regarding its products. The extensive 60-page legal document seeks a permanent injunction to prevent the defendants from sharing any content that the company believes misrepresents its devices, which includes reviews, videos, and comments. The complaint points to a multitude of posts across various platforms, highlighting allegations of product malfunctions and incidents of devices catching fire. However, it also encompasses negative reviews and opinions that Motorola claims are inaccurate. Two of the content creators mentioned in the lawsuit stated they were unaware of the case until they received a notification from X’s support team. The message informed them that their accounts were referenced in the legal proceedings, urging them to consider legal advice or remove the contested content. One creator mentioned that their post was based on a verified incident, where Motorola had replaced a malfunctioning device. They expressed concerns about the company's tactics, stating, "Brand is just mentally harassing us, and they want to set an example." Motorola is heavily reliant on the Indian market, which constitutes roughly 21% of its global smartphone shipments. Most of these shipments fall within the sub-$250 price range, where consumers heavily depend on online reviews and peer recommendations. Free speech advocates have criticized Motorola's complaint as overly broad. Apar Gupta, a legal expert and director at the Internet Freedom Foundation in New Delhi, warned that such sweeping legal actions could create a "chilling effect" on independent product reviews, which are essential for consumer safety and accountability. Madhav Sheth, CEO of local smartphone brand Ai+, supported stricter measures against misinformation, arguing that freedom of speech should not equate to a free pass for defamation. His comments have faced backlash, with critics suggesting that such actions might deter genuine product evaluations. Conversely, Sunil Raina, managing director of Lava International, highlighted the importance of constructive criticism, indicating that brands have a choice between intimidation and improvement when facing criticism. As this case unfolds, it could herald a shift in how brands manage online criticism in India. The aforementioned creator anticipates more legal actions in the future as new regulations around online content may increase the accountability of creators and platforms. Motorola, along with Google, Meta, and X, has yet to comment on the situation.
