Mississippi’s age assurance law puts decentralized social networks to the test

A sweeping age verification law in Mississippi is igniting debates over its impact on decentralized social media platforms like Bluesky and Mastodon. Last week, Bluesky announced it would block access to its services within the state, choosing not to comply with the stringent requirements of the new law. In a detailed blog post, the company cited its limited resources as a small team, making it difficult to implement the extensive technical changes mandated by the law. Concerns were also raised regarding the potential privacy implications of such a broad legislative measure. The law, known as HB 1126, mandates that social networks verify the age of all users before granting access. Recently, the Supreme Court rejected an emergency appeal that sought to delay the law's enforcement, leaving Bluesky with a stark choice: adhere to the law or face fines of up to $10,000 per user. In response, many users in Mississippi turned to VPNs as a workaround, although questions arose about the necessity of such measures, given that decentralized social networks were designed to limit governmental control. Eugen Rochko, the founder of Mastodon, took to social media to express his views on Bluesky's decision, emphasizing the importance of true decentralization. He pointed out that there is no central authority to impose restrictions on the decentralized network, a jab at Bluesky's centralized infrastructure. This sparked a lively exchange with Mike Masnick, a Bluesky board member, who cautioned that Rochko's comments could be misleading. He noted that while users can create their own instances of Mastodon, the larger servers still face the risk of substantial fines from the state. The nuances of the law pose challenges not just for Bluesky, but for any platform that allows user-generated content. The wording of the law could potentially target various online services, from message boards to video channels. As the discussion unfolded, it became clear that while Mastodon operates on a network of decentralized servers, Bluesky's infrastructure remains largely dependent on its own systems, even as new communities like Blacksky emerge to create their own personal data servers (PDS). For users in Mississippi, the blocking of access has led to creative solutions. Some have discovered they can still access Bluesky through third-party clients or by sideloading the app via alternative app platforms. Despite these temporary fixes, the broader implications of the law remain concerning, as it poses a significant threat to smaller platforms that cannot afford compliance costs. Mississippi's legislation is not an isolated case; several other states, including Arizona and Virginia, are considering similar age verification laws. The growing trend raises questions about the future of decentralized social networking and whether it can effectively resist the challenges posed by such regulations. While decentralized networks may offer a buffer against stringent legislation, the overarching trend of such laws could inadvertently favor larger, centralized platforms that have the resources to adapt. As the situation evolves, the discourse around decentralization and internet freedoms continues to grow, highlighting the need for a balanced approach to regulation that safeguards user rights without stifling innovation.
