Minnesota set to be first state to ban nudification apps

In a pioneering move, Minnesota has become the first state in the U.S. to enact legislation prohibiting nudification apps that facilitate the alteration of images to create sexualized representations of individuals. This groundbreaking law imposes significant penalties on developers of websites and applications that are designed to undress or sexually exploit images without consent. Under the new legislation, those responsible for creating such harmful services could face serious financial repercussions, including punitive damages if victims decide to pursue legal action. Furthermore, the state has the authority to block access to any offending products. Minnesota's attorney general is also empowered to levy fines up to $500,000 for each instance of a fake AI-generated nude reported, with the proceeds earmarked for supporting victims of sexual assault, domestic violence, and child abuse. On Wednesday, the Minnesota Senate achieved a unanimous vote of 65-0 to pass the bill, following its swift approval in the House the previous week, as reported by 19th News. Governor Tim Walz is anticipated to endorse the legislation, which is set to take effect in August. Senator Erin Maye Quade introduced the bill in response to alarming incidents where one individual had manipulated images of over 80 women within his community. Quade expressed her eagerness for the bill's signing, emphasizing the legal protections it will afford victims and those affected by the proliferation of nudifying apps. The bill’s passage was supported by RAINN, a national nonprofit organization that operates the National Sexual Assault Hotline. To mitigate potential industry backlash, RAINN collaborated with technology firms during the drafting process to safeguard popular software like Photoshop from unintended consequences associated with the ban. Recognizing the seriousness of the issue, which predominantly affects women and children worldwide, the law does allow for exceptions for products that necessitate significant technical expertise to manipulate images or videos.
