Microsoft says Copilot isn't just 'for entertainment purposes' after its terms of service language goes viral

Microsoft is taking steps to revise its Copilot Terms of Use after a recent surge of attention on social media highlighted the phrase that states the tool is intended 'for entertainment purposes only.' The company, striving to clarify its position, acknowledged that this language is outdated and does not accurately represent the current capabilities of Copilot, a spokesperson explained. This statement comes on the heels of users on X questioning the confidence Microsoft has in its AI tool, with the existing terms cautioning users about potential inaccuracies and encouraging them to use the tool at their own risk. Despite this cautious wording, CEO Satya Nadella praised the precision of Microsoft 365 Copilot during the latest earnings call, emphasizing its advanced features powered by the Work IQ intelligence tool. Interestingly, the Copilot agreement is not the sole user agreement in play; users also consent to Microsoft's broader Services Agreement, which does not include the 'entertainment purposes' language. Unlike Microsoft, competitors such as OpenAI, Anthropic, and Meta have refrained from using such phrasing in their terms, though they similarly address limitations to mitigate legal risks. The controversial wording has its roots in earlier iterations of the Copilot Terms of Use, dating back to February 2023. Notably, in November 2023, Microsoft rebranded its Bing Chat and Bing Chat Enterprise offerings as Microsoft Copilot to enhance accessibility. Experts like Shriram Krishnamurthi from Brown University have pointed out that unusual terms of service may be a hallmark of Microsoft's approach, reflecting its long history of quirky disclaimers. In contrast, other AI firms, including Elon Musk's xAI, have adopted more stringent liability clauses, requiring users to assume legal responsibility for their interactions with the platform. As the field of generative AI continues to evolve, legal challenges are rising regarding the accountability of AI companies for their systems' outputs. OpenAI, for example, is currently facing multiple lawsuits in California concerning the alleged harms caused by its AI models, highlighting the ongoing debate over the responsibilities of AI developers in ensuring user safety and trust.
