Central to the dispute is whether Amazon Web Services (AWS) can provide hosting for OpenAI’s new enterprise product, Frontier, without violating a longstanding contract that mandates all access to OpenAI’s models via application programming interfaces (APIs) must go through Microsoft’s Azure cloud platform. Since investing $1 billion in OpenAI in 2019 and an additional $10 billion earlier this year, Microsoft has seen significant benefits from this partnership, as OpenAI's tools have notably enhanced Azure revenue growth. However, sources indicate that Amazon and OpenAI are attempting to circumvent these contractual obligations. According to an insider familiar with Microsoft's stance, this workaround is not only impractical but could also breach the agreement's spirit. "We know our contract," this source stated. "We will sue them if they breach it. If Amazon and OpenAI want to gamble on the creativity of their contractual lawyers, I would put my money on us, not them."
