Meta wins antitrust trial as judge denies that it’s a monopoly

In a significant legal victory for Meta, the company has successfully defended itself against a five-year antitrust lawsuit initiated by the U.S. Federal Trade Commission (FTC) regarding its acquisitions of Instagram and WhatsApp. U.S. District Court Judge James Boasberg issued a ruling on Tuesday, stating that the FTC failed to demonstrate that Meta violated antitrust laws with its purchases of Instagram for $1 billion in 2012 and WhatsApp for $19 billion in 2014. The FTC did present evidence indicating that Meta, formerly known as Facebook, had concerns about the rapid growth of Instagram and the potential competition it represented. Internal communications revealed that Mark Zuckerberg acknowledged the strategic advantage of acquiring Instagram, stating, "One way of looking at this is that what we’re really buying is time." He emphasized that acquiring platforms like Instagram would provide Meta with the opportunity to integrate their features before any new competitors could match their scale. However, Judge Boasberg clarified that his ruling did not focus on whether Meta acted as a monopoly in the past, but rather assessed its current status in the market. He referenced emerging competitors, such as TikTok, to highlight that Meta is not operating in isolation. "The landscape that existed only five years ago, when the Federal Trade Commission brought this antitrust suit, has changed markedly," Boasberg noted in his memorandum opinion. He concluded that the previous delineation between social networking and social media markets has become increasingly blurred, indicating a more competitive environment today.
