A coalition of international plaintiffs has launched a lawsuit against Meta Platforms, Inc., contending that the tech giant has misrepresented the privacy and security of WhatsApp messages. This legal challenge, reported by Bloomberg, raises significant questions about the claims Meta has made regarding its messaging service’s end-to-end encryption—a feature that is marketed as ensuring that only the sender and receiver can access their communications. According to the plaintiffs, who filed their complaint in the US District Court in San Francisco, Meta’s assertions about WhatsApp’s encryption are misleading. They argue that the company retains the ability to store, analyze, and potentially access a vast majority of users’ supposedly private messages. This lawsuit seeks to hold Meta accountable for allegedly deceiving billions of WhatsApp users across the globe. Meta has firmly rejected these allegations, with a spokesperson labeling the lawsuit as “frivolous.” Andy Stone, a representative for Meta, emphasized in an email that the claim suggesting WhatsApp messages lack encryption is “categorically false and absurd.” He reassured users that WhatsApp has utilized the Signal protocol for end-to-end encryption for the past decade. The plaintiffs hail from various countries, including Australia, Brazil, India, Mexico, and South Africa. They assert that Meta not only stores message content but also allows employees access to this information. The complaint mentions unnamed “whistleblowers” who purportedly contributed to exposing these practices, though no further details are provided about their identities. The plaintiffs' legal team has requested that the court recognize the case as a class-action lawsuit. While several attorneys associated with the case have not commented, Jay Barnett from Barnett Legal has also chosen to withhold remarks regarding the matter.
