The case originated from a 2023 undercover investigation where state agents created fake accounts on Facebook and Instagram, posing as users under the age of 14. These accounts received explicit content and were solicited for sex by several men, leading to arrests in May 2024. The evidence gathered, alongside internal documents from Meta and testimonies from former employees, revealed a pattern of negligence concerning child safety. Damning testimonies came from former Meta employees, including Arturo Bejar, who recounted his attempts to alert executives after his own daughter faced unwanted advances on Instagram. He pointed out that the algorithms designed for user engagement could equally attract predators. “The product excels at connecting individuals with shared interests,” Bejar remarked, “which can be dangerous when those interests involve exploiting children.” Another former executive, Brian Boland, expressed that during his tenure, he did not see safety as a priority for CEO Mark Zuckerberg or then-COO Sheryl Sandberg. Zuckerberg’s deposition, shown to jurors, included contentious moments where he claimed research on platform addiction was inconclusive, despite evidence to the contrary from Meta’s own studies.
