As artificial intelligence (AI) continues to advance, chatbots are increasingly being utilized for more than simple tasks. Many users now seek advice and emotional support from these AI companions. However, recent developments raise critical questions about the safety of such interactions. A recent report from Reuters highlights warnings from U.S. attorneys advising clients against considering AI chatbots as secure or confidential sources for discussing sensitive legal matters. This caution follows a federal court ruling in New York, where a judge determined that a former executive must disclose communications he had with Anthropic’s Claude chatbot. This case, involving Bradley Heppner of GWG Holdings, who faces fraud allegations, underscores the potential risks associated with AI chat privacy. Judge Jed Rakoff ordered Heppner to submit documents created with the help of the chatbot, emphasizing that conversations with AI do not carry the same confidentiality protections as traditional lawyer-client dialogues. Legal experts are now alerting clients to the implications of using AI chatbots like Claude and ChatGPT, as these interactions could be accessed by prosecutors in criminal cases or leveraged by opposing parties in civil disputes. A client agreement from the law firm Sher Tremonte LLP explicitly warns against the use of AI chatbots, indicating that sharing sensitive information could compromise the legal protections afforded by attorney-client privilege. Yet, there is a contrasting perspective emerging from another court case. Judge Anthony Patti ruled in favor of an individual representing herself, allowing her to keep her interactions with OpenAI’s ChatGPT confidential, treating them as personal 'work-product.' As the legal landscape grapples with the implications of AI-assisted communications, the absence of clear regulations leaves users vulnerable. Experts advise exercising caution and refraining from discussing sensitive legal matters with AI chatbots until more definitive guidelines are established.
