
A lawyer representing Children's Health Defense, an organization staunchly opposed to vaccines and founded by Robert F. Kennedy Jr., has initiated legal proceedings against Kennedy himself. The lawsuit accuses him of neglecting his responsibility to establish a task force aimed at enhancing the safety of childhood vaccinations. This task force was mandated by the National Childhood Vaccine Injury Act of 1986, a significant law known for instituting the National Vaccine Injury Compensation Program. This program offers compensation to individuals who can substantiate claims of injuries caused by vaccinations, including rare and severe side effects. It serves as a no-fault alternative to expensive lawsuits against drug manufacturers, which could otherwise dissuade them from developing and marketing vaccines, ultimately jeopardizing public health and vaccination rates. According to the 1986 legislation, the U.S. health secretary is required to form a task force dedicated to the development of childhood vaccines that pose fewer risks and adverse effects than those available at the time. This task force is also tasked with submitting biennial progress reports to Congress. However, since the law's enactment, the task force has never submitted a report. While records indicate that a task force was created in 1990, it was disbanded in 1998 without producing any reports. The issue resurfaced in 2018 when Kennedy himself filed a lawsuit and a Freedom of Information Act request to the Department of Health and Human Services, seeking information on the task force's activities. The response from HHS in June 2018 revealed an inability to locate any records of the task force's work.
