RFK Jr. appeals ruling that wiped out his vaccine advisory panel

In a notable turn of events, the Trump administration is contesting a recent judicial ruling that has temporarily suspended controversial changes made by Health Secretary Robert F. Kennedy at the Centers for Disease Control and Prevention (CDC). This includes the controversial restructuring of a vital vaccine advisory panel, which had been filled with individuals known for their anti-vaccine stance, as well as significant reductions in childhood vaccination recommendations. On March 16, U.S. District Judge Brian Murphy issued a temporary injunction against these modifications, effectively nullifying the appointments made by Kennedy and invalidating any decisions these advisors made regarding federal vaccine policies. The judge's ruling also reinstated the previous CDC childhood vaccination schedule, determining that the advisors appointed by Kennedy lacked the necessary qualifications and that the changes violated established federal procedures. This legal challenge originated from a lawsuit filed by the American Academy of Pediatrics (AAP) against Kennedy and the Department of Health and Human Services (HHS). The government's attorneys previously contended that Kennedy’s authority was so expansive that it could not be subjected to legal review, even suggesting that he could theoretically recommend individuals receive measles virus injections instead of vaccinations. However, Murphy dismissed this argument, indicating that the AAP had a strong likelihood of succeeding in their legal claim that Kennedy’s alterations were unlawful. As a result of the injunction, the CDC’s vaccine advisory panel, known as the Advisory Committee on Immunization Practices (ACIP), is currently in limbo. A meeting that was set to take place later in March to address concerns regarding alleged COVID-19 vaccine injuries has been canceled, leaving the committee's future agenda uncertain as they plan for a late June meeting without a clear path forward.
