Lawsuit against Elon Musk's xAI alleges Grok created sexualized deepfakes of 3 minors

A recent lawsuit has been filed against Elon Musk's xAI, alleging that its prominent chatbot, Grok, was exploited to generate sexually explicit deepfake images involving three minors. The complaint, lodged in a California federal court, labels the created content as child sexual abuse material and accuses the AI company of profiting from heinous acts against vulnerable individuals, including children. The lawsuit highlights that many companies within the AI sector have recognized the potential dangers of such technology and have implemented safeguards to prevent misuse, particularly by child predators. In stark contrast, the filings claim that xAI failed to take similar precautions. Representatives for Musk and xAI have yet to respond publicly to requests for comments regarding the allegations. Musk previously stated that he was unaware of any explicit images generated by Grok, asserting that the chatbot is designed to refuse requests for illegal content. He noted that Grok operates under the legal frameworks applicable in various jurisdictions and asserted that any unexpected misuse would be swiftly addressed by the company. The lawsuit identifies the plaintiffs only as Jane Doe 1, Jane Doe 2, and Jane Doe 3, asserting that they are victims of xAI's alleged production, possession, and distribution of AI-generated child sexual abuse materials. According to the complaint, Jane Doe 1, now an adult, was a minor during the time of the alleged incidents, while the other two plaintiffs are still underage. The troubling allegations detail how Jane Doe 1 received a warning via Instagram about explicit images circulating online, reportedly created by someone she knew. The complaint notes that these images, which depicted her and other minors in sexualized contexts, were shared on the messaging platform Discord. Investigations revealed that the images included explicit representations of Jane Doe 1's likeness, with one video showing her undressing. Following these discoveries, Jane Doe 1 informed the other minors involved, prompting a criminal investigation in Tennessee, which resulted in the arrest of a suspect linked to the case. As the investigation unfolded, Jane Doe 2 learned that at least two of her images had also been transformed into sexually explicit deepfake content, while Jane Doe 3 was informed that similar alterations had been made to her likeness. Attorney Vanessa Baehr-Jones, representing the plaintiffs, described the situation as a “nightmare” for her clients, emphasizing the severe and lasting impact of having their images circulated among child predators. The lawsuit seeks unspecified damages and includes claims against xAI for various charges related to child pornography. Baehr-Jones expressed hope that the lawsuit will ensure accountability for xAI and prevent similar incidents in the future. The case follows significant backlash against Grok earlier this year, after reports surfaced of the chatbot being used to create non-consensual sexualized images. In response to public outcry, xAI announced that Grok would no longer generate images of real people in sexually suggestive scenarios. The situation has garnered attention from authorities, including ongoing investigations by French law enforcement concerning Grok's functionality.
