Emerging legislation would shield polluters from liability for climate change

In a significant move, Republican lawmakers across various states and at the federal level are championing legislation that could exempt polluters from facing accountability for climate-related damages. This development comes as the impacts of climate change become increasingly apparent and costly. The push for these legal protections marks a counter-offensive against numerous lawsuits being filed by local communities, states, and individuals targeting major oil and gas corporations. These litigations accuse these companies of not only contributing to climate change but also misleading consumers about the associated risks and potential solutions. At the same time, several states are contemplating laws inspired by the federal Superfund program, which would impose retroactive liabilities on large fossil fuel producers. These proposed measures aim to generate financial resources for climate adaptation and resilience initiatives. However, the future of these lawsuits and climate superfund initiatives hangs in the balance. The conservative majority of the U.S. Supreme Court could potentially halt these efforts. Recently, the court agreed to review a petition from oil giants Suncor and ExxonMobil, who are contesting a climate-damages lawsuit filed by Boulder, Colorado. Their argument centers on the claim that federal law bars Boulder’s allegations, which, if upheld, could jeopardize not only this case but many others as well. As the Supreme Court prepares for its upcoming term in October, there are concerns that congressional Republicans may act even sooner to grant the fossil fuel industry similar legal immunity as that provided to gun manufacturers under the Protection of Lawful Commerce in Arms Act of 2005. Notably, sixteen Republican attorneys general have already reached out to the U.S. Attorney General, proposing that the Department of Justice advocate for legislation to establish such a liability shield. Furthermore, one Republican congresswoman recently revealed that efforts to draft this legislation are actively underway.
