Amidst legal turmoil, Kalshi is temporarily banned in Nevada

Kalshi is experiencing significant legal hurdles this week. On Tuesday, the Attorney General of Arizona initiated a criminal complaint comprising 20 counts against the online prediction market, alleging it is operating an unlawful gambling business within the state. Now, Nevada has joined the fray, with a judge temporarily prohibiting Kalshi from conducting business in the state. This legal action is part of an ongoing lawsuit filed by the Nevada Gaming Control Board, which originally targeted Kalshi in February to prevent it from operating without the necessary gaming licenses. State officials argue that Kalshi has not secured the appropriate licenses for the betting activities its users engage in, and they contend that permitting users under the age of 21 to access its services breaches state regulations. Earlier this month, the state sought a temporary restraining order against Kalshi, leading to a court hearing on Friday, where Judge Jason D. Woodbury granted the request and scheduled a follow-up hearing for early next month. In his ruling, Judge Woodbury noted that Kalshi lacks a license under the Nevada Gaming Control Act and classified the company's commission-based model from contracts as a “percentage game,” which the state defines as gambling. Kalshi has countered that its registration with the Commodity Futures Trading Commission (CFTC) places it solely under federal oversight, suggesting that state laws should not apply. However, Woodbury highlighted that the legal question of whether federal regulations supersede state laws remains unresolved, with courts generally not favoring this interpretation. Kalshi opted not to comment on the situation when approached by TechCrunch. The judge's decision was initially reported by Wired, and Reuters noted that Nevada has succeeded in securing court orders against Kalshi's competitors, including Coinbase and Polymarket. The case in Nevada is part of an increasing wave of legal actions across various states aimed at challenging the legality of platforms like Kalshi and Polymarket, which are said to evade state gambling laws. In contrast, federal authorities have positioned themselves as defenders of the prediction market sector. Following Arizona's criminal filing against Kalshi, CFTC Chairman Mike Selig publicly criticized the move, asserting that it constitutes a jurisdictional dispute inappropriate for criminal prosecution. He stated, “The CFTC is watching this closely and evaluating its options.” The growing tension between state regulators and federal oversight is setting the stage for a significant regulatory conflict over the future of prediction markets.
