
Italy's regulatory body has mandated that Meta cease its controversial policy restricting the use of WhatsApp’s business tools by rival AI chatbot developers. The Italian Competition Authority (AGCM) announced its findings from an ongoing investigation, indicating that Meta may be abusing its dominant market position by prioritizing its own AI chatbot offerings within the app. The AGCM expressed concerns that Meta's actions could stifle innovation and limit market access for other AI chatbot services, ultimately harming consumers. They noted, "Meta’s conduct appears to constitute an abuse, since it may limit production, market access, or technical developments in the AI Chatbot services market, to the detriment of consumers." In response to a policy change made in October, which banned general-purpose chatbots from utilizing WhatsApp's API, the AGCM expanded its investigation. Meta has defended its stance, claiming that its API is not intended to serve as a platform for chatbot distribution and that users still have other options for accessing AI bots outside of WhatsApp. This new policy, set to take effect in January, threatens to restrict the availability of popular AI chatbots like OpenAI's ChatGPT and others on the platform. However, businesses employing AI for customer service through WhatsApp will not face restrictions. For example, retailers using AI-powered support bots can continue to operate normally. Additionally, the European Commission has initiated its own inquiry into Meta's policy, voicing concerns that it may hinder third-party AI services from operating within the European Economic Area (EEA). Meta has yet to respond to requests for further comment on the matter.
