In a significant move against video game piracy, authorities have dismantled a prominent website associated with the illegal distribution of Nintendo Switch game files. The FBI took action to seize Nsw2u, a site notorious for offering unauthorized access to Switch ROMs. Users attempting to access the site are now met with a notice detailing the seizure, executed under a warrant from the United States District Court for the Northern District of Georgia. This operation was not solely a U.S. initiative; it also saw collaboration from the Dutch financial crime agency, FIOD, underscoring a coordinated international effort to combat piracy in the gaming industry. Nsw2u had attracted a substantial user base by providing digital copies of games that could be played on modified consoles or through emulators on PCs. Remarkably, just hours before the site was taken offline on July 10, users were still able to download games. Earlier this year, Nsw2u was placed on the European Union’s piracy watchlist, indicating a growing global focus on tackling piracy. The notice displayed on the site stated, "This domain has been seized by the Federal Bureau of Investigation in accordance with a seizure warrant issued pursuant to 18 U.S.C. 2323... as part of a law enforcement operation and action by the Federal Bureau of Investigation," also acknowledging FIOD's involvement in the operation. Nintendo has long been proactive in its fight against piracy. In 2023, the company targeted the developers of the Yuzu emulator, software that allows users to play Switch games on PCs and other portable devices. Additionally, it has pursued legal action against smaller sites hosting ROMs and manufacturers of devices that circumvent Nintendo's copyright protections. Following the recent launch of the new Switch 2 console, Nintendo has implemented strict measures that deny access to online services for users employing unauthorized storage devices. This rigorous stance against piracy includes seeking substantial fines and prison sentences for offenders. However, the company's latest strategy to restrict Switch 2 consoles from accessing essential features due to piracy apprehensions has sparked concerns, including a legal challenge in Brazil regarding its potential impact on legitimate second-hand market transactions.
