Instacart to pay $60 million to settle FTC claims it deceived customers

Instacart has agreed to pay $60 million to resolve allegations from the Federal Trade Commission (FTC) claiming it misled customers through false advertising and questionable subscription practices. The FTC's investigation revealed that Instacart employed deceptive strategies during its subscription sign-up process and in promoting its 'satisfaction guarantee,' resulting in consumers incurring additional fees and facing obstacles in obtaining refunds. A key point in the FTC's allegations is that Instacart advertised 'free delivery' for first-time customers, yet these users were still required to pay a mandatory service fee for their grocery deliveries. Furthermore, the commission asserted that the company misrepresented its refund policies, assuring customers of full refunds for order issues that were not honored. Christopher Mufarrige, director of the FTC's Bureau of Consumer Protection, stated, "Instacart misled consumers by advertising free delivery services — and then charging consumers to have groceries delivered — and failing to disclose to consumers that signed up for a free trial that they would be automatically enrolled into its subscription program." In response, Instacart acknowledged the settlement but denied any allegations of wrongdoing. The grocery delivery service emphasized its commitment to using transparent marketing practices, clear pricing structures, and straightforward cancellation processes. An Instacart spokesperson remarked, "This settlement allows us to move forward and remain focused on what's important to our company: delivering value for customers, shoppers, and retail and brand partners in the communities we serve." This settlement comes as Instacart is reportedly under a different investigation by the FTC regarding its pricing methods. This inquiry was initiated after a recent study indicated that the company's algorithmic pricing tools led to varying prices for the same items within the same store. Following the news of the FTC investigation, Instacart's stock experienced a decline of about 7% in after-hours trading on Wednesday and continued to fall by more than 1% the following day. The FTC has intensified its scrutiny of companies accused of deceptive billing and enrollment practices. Earlier this year, the agency took action against Uber for allegedly charging users for subscriptions without their consent, and recently filed a lawsuit against Live Nation and Ticketmaster for employing 'bait-and-switch' pricing tactics. In a separate initiative, the FTC announced it would be distributing over $27.6 million to consumers who were unknowingly enrolled in plans that charged them for products marketed with exaggerated health benefits.
