New online gaming rules from May 1: Violations will see 3-yr jail term, ₹1 crore in fines

India is preparing for a comprehensive update to its online gaming regulations, set to take effect on May 1, 2026. This reform is anchored in the recently enacted Promotion and Regulation of Online Gaming (PROG) Act, 2025, which transitions the gaming landscape from mere policy discussions to enforceable laws. At the heart of this new framework is a crucial differentiation: while e-sports and socially interactive online games will be permitted, all forms of online money gaming are strictly prohibited. This decision comes in response to escalating concerns regarding gambling addiction, financial detriment, and illicit activities associated with online gaming. The significance of these regulations cannot be overstated. India's online gaming market has experienced remarkable growth, reaching an estimated ₹23,200 crore in revenue in 2024 and projected to grow to ₹31,600 crore by 2027. However, this boom has also brought about serious issues, with approximately 45 crore individuals reportedly impacted by online money gaming, resulting in total losses exceeding ₹20,000 crore. The government’s strategy aims to promote safe gaming innovations while imposing stringent controls on high-risk gaming segments. As of May 1, a structured regulatory framework will come into play, introducing several key changes. A notable aspect is the establishment of the Online Gaming Authority of India, a digital-first regulatory body operating under the Ministry of Information Technology. This authority will evaluate games based on various criteria, including stakes, potential winnings, and monetization methods, with decisions expected within a 90-day timeframe. Additionally, e-sports and approved online social games will be required to register, obtaining a digital certification valid for up to ten years. Service providers will also face new compliance obligations. The regulations will implement layered protective measures, including a two-tier grievance redressal mechanism, where complaints are initially addressed by gaming platforms and can be escalated to the regulator if necessary. Enforcement will primarily be conducted through digital channels, with expectations for resolving cases within 90 days. Penalties will be carefully calibrated to consider the harm caused to users, the benefits derived from violations, and any repeat offenses. Ultimately, the government aims to strike a balance between fostering innovation in the gaming sector and ensuring consumer protection. With these clearly defined rules and a centralized regulatory authority, India’s gaming industry is set to enter a new era of accountability and oversight.
