HP India hit with Rs 142 crore CCI fine for anti-competitive practices

The Competition Commission of India (CCI) has imposed a hefty fine of ₹142.37 crore on HP India and its network of resellers due to allegations of anti-competitive practices. This ruling stems from two distinct cases that focus on the collusion in the sale and distribution of personal system products, including PCs, laptops, and associated hardware. These actions, which may involve price fixing, coordinated bidding, or market manipulation, violate Indian competition laws. CCI has mandated HP India and its resellers to cease these practices immediately, as stipulated under Section 3 of the Competition Act of 2002. Specifically, HP India faces a penalty of ₹126.87 crore, while five of its resellers are liable for approximately ₹1.22 crore. In a separate directive, HP India was also fined ₹11.98 crore, with sixteen of its resellers collectively fined ₹2.30 crore, related to the sale of printer consumables, such as toner and ink cartridges. The CCI's findings indicate that these resellers engaged in seeking and submitting cover bids, breaching Section 3(3)(d) and Section 3(1) of the Act. The commission highlighted HP India's pivotal role in orchestrating this cartel among its resellers. The investigation identified 16 resellers implicated in these anti-competitive activities, which include notable firms like DD Enterprises, Ascent Information, Kaypee Enterprises, and others. The proceedings were initiated following a lesser penalty application submitted by HP India, alleging collusion among itself and its resellers. This situation underscores the ongoing scrutiny of corporate practices within the Indian market.
