In a significant legal victory, Harvard University has successfully challenged the Trump administration in a federal court, compelling the government to reinstate approximately $2.6 billion in funding that had been frozen. This ruling from US District Judge Allison Burroughs criticized the Supreme Court for seemingly disregarding established precedents without adequate justification. The Trump administration had justified its decision to cut Harvard's funding by alleging rising antisemitism at the institution. However, Judge Burroughs contested this claim, noting that the evidence presented suggested the administration was employing antisemitism as a pretext for targeting prestigious universities. The judge's ruling pointed out that the government's actions violated the Administrative Procedure Act (APA) and the First Amendment rights. While Harvard has acknowledged it has faced challenges related to antisemitism in recent years, the judge emphasized that there was minimal correlation between the funding cuts and the allegations of antisemitism. The federal government initially froze $2.2 billion in funding on April 14, followed by additional funding cuts. Harvard's legal battle commenced in the District of Massachusetts, seeking to overturn these funding reductions. The case can be appealed to the US Court of Appeals for the 1st Circuit. Judge Burroughs observed that the letters sent by the government to Harvard did not recognize the university's efforts to address antisemitism and failed to provide specific instances of such behavior on campus. In a notable footnote, Burroughs addressed recent remarks by Supreme Court Justice Neil Gorsuch regarding lower courts' adherence to Supreme Court rulings. She underscored the importance of maintaining the hierarchical structure established within the federal court system, emphasizing that all judges must respect this framework regardless of personal opinions.
